Terms and Conditions
Effective and last updated:
1. Acceptance of these terms
These Terms and Conditions (“Terms”) govern your use of the Dayclipse mobile app (the “App”) and this website (the “Site”), provided by the developer of Dayclipse (“we,” “us”). By downloading or using the App or Site, you agree to these Terms. If you do not agree, please do not use them.
2. Description of Dayclipse
Dayclipse calculates and displays astronomical information — such as sunrise and sunset, golden and blue hour, twilight, Sun and Moon positions, Moon phases and moonrise and moonset — for locations you select. It includes tools such as a photography planner, compass-aware dials, AR Sky View and shareable images. Features are described on our Features page.
3. Eligibility
You may use Dayclipse if you can form a binding agreement under the laws that apply to you, or with the involvement of a parent or guardian. The App is a general-audience app and is not directed to young children.
4. Permitted use and license
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your personal, non-commercial use, in line with these Terms and the rules of the app store you downloaded it from. Images you create with the App's Share feature are yours to share.
5. Prohibited activities
- Copying, modifying, reverse engineering or redistributing the App, except where the law expressly permits it.
- Removing or obscuring copyright, trademark or license notices.
- Using the App or Site in a way that breaks the law or infringes others' rights.
- Interfering with, overloading or attempting to gain unauthorized access to the Site or related services.
6. Intellectual property
The App, the Site, the Dayclipse name and logo, and their design and content are owned by us or our licensors. Third-party components are used under their own licenses, listed in the App under Settings → Credits & licenses — for example, world city data from SimpleMaps (CC BY 4.0) and time-zone data from the IANA tz database.
7. Your responsibilities
- Use your own judgment and stay aware of your surroundings, especially outdoors, near traffic, water or cliffs, and in the dark.
- Never look directly at the Sun, with or without a phone, camera or optical device. AR Sky View is designed so you can aim using the screen.
- Check local conditions and official sources before relying on light or darkness for any activity.
8. Third-party services
The App uses Google Firebase Analytics and Crashlytics, and the operating system's camera, sensors, share sheet and store review features. Their availability and behavior are controlled by those third parties and your device. See our Privacy Policy.
9. Google Play and Apple App Store
If you obtained the App from Google Play or the Apple App Store, the store's terms also apply. These Terms are between you and us, not the store operator. Apple and Google are not responsible for the App, its maintenance or support, or any claims relating to it, and are not liable for any warranty failure beyond any refund of the purchase price (if any) that their policies provide.
For Apple users: Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties.
10. Service updates
We may update, change or remove features of the App or Site to improve them, fix problems or comply with law. Some updates may be needed to keep using the App.
11. Availability and interruptions
We aim to keep the App and Site working, but we do not promise they will always be available, uninterrupted, error-free or compatible with every device or operating system version.
12. Accuracy of astronomical calculations
Dayclipse uses established astronomical algorithms, but every result is an estimate. Calculated times and positions may differ from what you observe because of:
- the city coordinates used, which approximate your exact position;
- elevation, which the calculations do not take into account;
- atmospheric refraction, which varies from the standard value used;
- local horizon obstructions such as terrain, trees and buildings;
- weather, haze and air quality;
- time-zone and daylight-saving data, which governments can change; and
- the limits of the calculation models themselves.
We do not guarantee that any time or position is exact.
13. Location limitations
Dayclipse does not use GPS. Results describe the city you select, and they match your sky only if you are at or near that place. You are responsible for choosing an appropriate location.
14. Compass and sensor limitations
Compass and motion readings depend on your device's hardware and calibration and can be affected by magnetic interference from metal, magnets, vehicles and electronics, and by proximity to the magnetic poles. True north is derived from an offline magnetic model that may be unavailable or less accurate for some places and dates. Headings may be wrong without warning.
15. AR Sky View limitations
AR Sky View overlays calculated positions on a live camera image. Alignment depends on sensors, camera field-of-view data and calibration and may be offset. The horizon line shows the true horizon, not the visible skyline. AR Sky View is a visual aid only — do not use it while walking, driving or in any situation that requires your attention.
16. Not for navigation or safety-critical use
Dayclipse is an informational and recreational tool. It must not be used as a substitute for professional navigation equipment, aviation or marine sources, safety-critical systems or emergency guidance, or to decide when it is safe to travel, hunt, fly, sail or undertake any hazardous activity.
17. Warranties and disclaimers
To the extent permitted by law, the App and Site are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. Some jurisdictions do not allow certain warranties to be excluded, so some of these exclusions may not apply to you.
18. Limitation of liability
To the extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or opportunities, arising from your use of or inability to use the App or Site. To the extent permitted by law, our total liability for any claim relating to the App or Site is limited to the greater of the amount you paid for the App (if any) or USD 50.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, such as liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory rights as a consumer.
19. Indemnification
To the extent permitted by law, you agree to indemnify us against claims, losses and reasonable costs arising from your breach of these Terms or misuse of the App or Site. This section does not apply to consumers where such an obligation is not enforceable.
20. Termination
You may stop using Dayclipse at any time by uninstalling the App. We may suspend or end your license if you materially breach these Terms. Sections that by their nature should survive (such as intellectual property, disclaimers and limitation of liability) survive termination.
21. Governing law
These Terms are governed by the laws of the jurisdiction in which the developer of Dayclipse is established, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of your country or state of residence.
22. Mandatory consumer rights
If you live in the European Union, the United Kingdom or another place with mandatory consumer protection laws, nothing in these Terms affects your statutory rights, including any rights relating to digital content that is faulty or not as described.
23. Disputes
If you have a concern, please contact us first at godomainz@gmail.com so we can try to resolve it informally. If we cannot, you may bring a claim in the courts that have jurisdiction under applicable law. Consumers may bring proceedings in the courts of their place of residence where the law allows.
24. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect, and the invalid provision is applied to the maximum extent permitted.
25. Changes to these terms
We may update these Terms from time to time. We will post the updated version on this page and change the date above. If you keep using Dayclipse after changes take effect, the updated Terms apply.
